Member Agreement — Safety First (Summary)

By subscribing to Safety First, you enter a fixed-term Safety for Life membership and agree that this is a 12-month contractual commitment, not a casual, pay-as-you-go service.

• Price & Minimum Term: NZD $40 per week for a fixed 12-month minimum term (52 weeks). On signup you acknowledge a total annual obligation of $2,080. Weekly billing is a payment schedule only.
• Early Exit (Pay-Out): You can request to exit at any time by paying the Remaining Annual Balance (all unpaid weeks in the 12-month term). Access ends once that balance is fully paid.
• Auto-Renewal: Your membership auto-renews for another 12-month term on each anniversary unless you act before renewal. You will receive reminder emails (30 / 14 / 7 days) with a one-click “Do Not Renew” option.
• Missed Payments & Default: First failed payment = retry + reminder. A second consecutive fail may place your account in Default, allowing us to accelerate the Remaining Annual Balance, apply default interest (OCR + 8% p.a.) and fees as set out in Annex A — Fees & Default Schedule, and begin collection action.
• Refunds: Payments are non-refundable once processed, except where required by New Zealand law.
• Your Rights: Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 for services supplied to personal/consumer members.

Advisor Agreement — Safety First (Summary)

Advisors help people join Safety First and support basic follow-up on missed payments. You are rewarded through commissions and remain a fully independent contractor, not an employee.

• Status: You act as an independent contractor Advisor — not an employee, partner, or agent. You must not provide legal, financial, or medical advice or describe yourself as an “advocate”.
• Earnings — Safety for Life Plan: You receive 50% of each standard Safety for Life subscription — currently $20 per settled subscriber week on the $40/week plan, for members you have referred, paid only on cleared, non-refunded payments.
• Earnings — Custom Safety Packages: For approved customised individual safety plans priced on application, you earn 50% of the net price actually paid by your referred member, as recorded in our system.
• Responsibilities: Use only approved messages and templates, follow the missed-payment workflow (24-hour resend → BECS switch → Pay-Out offer), log all contact attempts in the portal, respect privacy rules, and never handle raw card or bank details.
• Compliance & Monitoring: Your activity may be monitored for conduct, accuracy, and compliance with New Zealand law (including the Privacy Act 2020 and Fair Trading Act 1986). Misrepresentation, harassment, or data misuse may result in suspension or termination.
• Termination & Clawback: Either party may terminate the Advisor relationship. Commissions are only payable on settled payments; Safety First may reverse or claw back commissions in cases of refund, fraud, chargeback, or breach of the Advisor Terms.
